The crash of two 737 MAX passenger aircraft in late 2018 and early 2019, and subsequent grounding of the entire fleet of 737 MAX jets, turned a global spotlight on Boeing’s practices and culture. Explanations for the crashes include: design flaws within the MAX’s new flight control software system designed to prevent stalls; internal pressure to keep pace with Boeing’s chief competitor, Airbus; Boeing’s lack of transparency about the new software; and the lack of adequate monitoring of Boeing by the (...) FAA, especially during the certification of the MAX and following the first crash. While these and other factors have been the subject of numerous government reports and investigative journalism articles, little to date has been written on the ethical significance of the accidents, in particular the ethical responsibilities of the engineers at Boeing and the FAA involved in designing and certifying the MAX. Lessons learned from this case include the need to strengthen the voice of engineers within large organizations. There is also the need for greater involvement of professional engineering societies in ethics-related activities and for broader focus on moral courage in engineering ethics education. (shrink)

The literature on self-driving cars and ethics continues to grow. Yet much of it focuses on ethical complexities emerging from an individual vehicle. That is an important but insufficient step towards determining how the technology will impact human lives and society more generally. What must complement ongoing discussions is a broader, system level of analysis that engages with the interactions and effects that these cars will have on one another and on the socio-technical systems in which they are embedded. To (...) bring the conversation of self-driving cars to the system level, we make use of two traffic scenarios which highlight some of the complexities that designers, policymakers, and others should consider related to the technology. We then describe three approaches that could be used to address such complexities and their associated shortcomings. We conclude by bringing attention to the “Moral Responsibility for Computing Artifacts: The Rules”, a framework that can provide insight into how to approach ethical issues related to self-driving cars. The opinion of Mr. Justice Francis of the English High Court which denied the parents of Charlie Gard, who had been born with an extremely rare mutation of a genetic disease, the right to take their child to the United States for a proposed experimental treatment occasioned world wide attention including that of the Pope, President Trump, and the US Congress. The case raise anew a debate as old as the foundation of Western medicine on who should decide and on (...) what standard when there is a conflict between a family and the treating physicians over a possible treatment. This paper will explore the different approaches of the British and American courts on the issue and the various proposals from that of John Rawls in his A Theory of Justice to a processed-based approach for resolving such disputes. As carefully crafted as the opinion of Mr Justice Nicholas Francis in the Gard case proved to be, it left commentators unsatisfied. A widespread criticism, captured in an article by Michael Dougherty in The National Review was for the state to ‘get out of the way of the parents trying to act in the best interests of the child’.1 Although he conceded the parents could be adding to the suffering of the child by taking Charlie to America for an experimental therapy and agreed that such a choice ‘may be the wrong decision,’ in Dougherty’s view, it should still be ‘their decision’. Dougherty’s stand was the popular response to the question of ‘Who should decide?’ It fails, however, to propose any rationale for the decision. It provided no norms, no standards and no guidelines for the parents. Their motive could equally well be indifference to the suffering of the child as concern for his well-being. Many pop culture pundits find characteristics of Jewish humor in their analysis of Jon Stewart's Jewish identity. Though no one has ever suggested that Stewart's a “good Jew,” Stewart still radiates a Jewish persona. This persona and Stewart's satiric treatment of Judaism echo Martin Buber's philosophy. What links the great humanist and the contemporary television satirist is that both point to the outside world and then explain to others what they should have seen. Our pursuit of Buber begins with Stewart's (...) life as a Jew. While it's impossible to watch The Daily Show without Stewart's Jewish persona being obvious, hearing an echo of Martin Buber's philosophy of engagement requires that we carefully review how Stewart's Jewish persona represents the great humanist. Buber insisted on political involvement and the seamless convergence of religion, ethics, politics, education, and art. (shrink)

In an interview in Rolling Stone magazine, Jon Stewart explained that the point of view of The Daily Show “is that we're passionately opposed to bullshit.” This might explain why Stewart invited Ivy League philosopher Harry Frankfurt to appear on The Daily Show (March 14, 2005) to discuss his bestseller On Bullshit. Philosopher‐comedian Stewart followed up the discussion of the lie/bullshit distinction with the following question, which he posed to Frankfurt but never quite let him answer: “What is the difference (...) between bullshit and political spin?” This chapter briefly considers Frankfurt's second visit to The Daily Show (January 9, 2007) when he discussed a much less sensational topic than bullshit. In his second very little book entitled On Truth—with its gold‐foiled cover that made Stewart think it would contain chocolates—Frankfurt is not very concerned with the “boring” philosophical question about the nature, or definition, of truth. Recent scholarship in intellectual humility (IH) has attempted to provide deeper understanding of the virtue as personality trait and its impact on an individual's thoughts, beliefs, and actions. A limitations-owning perspective of IH focuses on a proper recognition of the impact of intellectual limitations and a motivation to overcome them, placing it as the mean between intellectual arrogance and intellectual servility. We developed the Limitations-Owning Intellectual Humility Scale to assess this conception of IH with related personality constructs. In Studies 1 (...) (n= 386) and 2 (n = 296), principal factor and confirmatory factor analyses revealed a three-factor model – owning one's intellectual limitations, appropriate discomfort with intellectual limitations, and love of learning. Study 3 (n = 322) demonstrated strong test-retest reliability of the measure over 5 months, while Study 4 (n = 612) revealed limitations-owning IH correlated negatively with dogmatism, closed-mindedness, and hubristic pride and positively with openness, assertiveness, authentic pride. It also predicted openness and closed-mindedness over and above education, social desirability, and other measures of IH. The limitations-owning understanding of IH and scale allow for a more nuanced, spectrum interpretation and measurement of the virtue, which directs future study inside and outside of psychology. In face of the multiple controversies surrounding the DSM process in general and the development of DSM-5 in particular, we have organized a discussion around what we consider six essential questions in further work on the DSM. The six questions involve: 1) the nature of a mental disorder; 2) the definition of mental disorder; 3) the issue of whether, in the current state of psychiatric science, DSM-5 should assume a cautious, conservative posture or an assertive, transformative posture; 4) the role (...) of pragmatic considerations in the construction of DSM-5; 5) the issue of utility of the DSM – whether DSM-III and IV have been designed more for clinicians or researchers, and how this conflict should be dealt with in the new manual; and 6) the possibility and advisability, given all the problems with DSM-III and IV, of designing a different diagnostic system. Part 1 of this article took up the first two questions. Part 2 took up the second two questions. Part 3 now deals with Questions 5 & 6. Question 5 confronts the issue of utility, whether the manual design of DSM-III and IV favors clinicians or researchers, and what that means for DSM-5. Our final question, Question 6, takes up a concluding issue, whether the acknowledged problems with the earlier DSMs warrants a significant overhaul of DSM-5 and future manuals. In the conclusion to this multi-part article I first review the discussions carried out around the six essential questions in psychiatric diagnosis – the position taken by Allen Frances on each question, the commentaries on the respective question along with Frances’ responses to the commentaries, and my own view of the multiple discussions. In this review I emphasize that the core question is the first – what is the nature of psychiatric illness – and that in some manner all further (...) questions follow from the first. Following this review I attempt to move the discussion forward, addressing the first question from the perspectives of natural kind analysis and complexity analysis. This reflection leads toward a view of psychiatric disorders – and future nosologies – as far more complex and uncertain than we have imagined. (shrink)

Jason Springs’s Healthy Conflict in Contemporary American Society is a masterful attempt to practice productive conflict and democratic dialogue in the face of static antagonisms and deep‐seated divisions. In my response, I underscore Springs’s insistence on mediating between the moral imagination of Richard Rorty and the prophetic critique of Cornel West. For the author of Healthy Conflict, any hope in the survival of democracy relies on balancing critique of domination with constructive proposals for a more just and equitable world. (...) On the one hand, Springs rejects any strong distinction between moral imagination and socio‐political critique; in fact, he argues for their intertwinement, especially in the work of West. At the same time, there are moments when he suggests an opposition between expanding the moral imagination and engaging in the critical enterprise, especially as he identifies the limits in Foucault regarding normativity and democratic struggle. I respond to this slippage by arguing that Foucault, and critical theory more broadly, open up possibilities for rethinking ethics, politics, and our relationship to the violence that sustains the order of things. The second question again offers a range of opinion as to how we should define a mental or psychiatric disorder, including the possibility that we should not try to formulate a definition. From many Aboriginal elders, such as Tjangika Napaltjani, Bob Williams and Djiniyini Gondarra, to painters, such as Arthur Boyd, Pro Hart and John Forrester-Clack, from historians, such as Manning Clark, and poets, such as Maureen Watson, Francis Webb and Henry Lawson, to celebrated novelists, such as Joseph Furphy, Patrick White and Tim Winton, the figure of Jesus has occupied an endearing and idiosyncratic place in the Australian imagination. It is evidence enough that 'Australians have been anticlerical and antichurch, but (...) rarely antiJesus'. But which Jesus? In what follows, I seek to listen to what some Australians make of Jesus, and to consider some theological implications of their contributions for the enduring quest for an Australian Jesus. In a series of articles written for the Neue Rhenische Zeitung in 1850, later published by Friedrich Engels as The Class Struggles in France, Karl Marx looked back on the failed French revolution of 1848 and attempted to explain how the democratic aspirations that inspired the February assault on the July Monarchy-and promised to fulfill the dashed hopes of 1789, 1792, and 1830-also led to its termination in the reactionary popular dictatorship of Louis Napoleon Bonaparte. Popular sovereignty, which had so (...) often defined the emancipatory visions of two generations of radical activists and thinkers was now not only an obstacle to genuine emancipation, but a plebiscitary source of power for newly emergent forms of political domination. Bonapartism became, for Marx, an important way of understanding the complex internal dynamics of popular-and later "populist"-authoritarianism. It is an analysis that continues to resonate powerfully today. The national enthusiasm that propelled the revolution forward, and which overturned the hated regime of Louis Phillippe in three glorious days, had successfully established for the first time in history a parliamentary republic based in universal male suffrage. The Second Republic's provisional government was immediately thrown into a legitimation crisis, however, by the underlying sectional, parliamentary, and class conflicts lurking beneath its illusory foundation in the people's unitary will. When the popular classes of Paris returned to the barricades in June to protest the conservative government's closure of the National Workshops-and to convert the political revolution into a social revolution based in the "right to work"-they were abandoned by their fellow citizens and thousands were massacred in the streets by Cavaignac's National Guard. The "fantastic republic" built around the pretensions of national unity, Marx proclaimed, quickly "dissolved in powder and smoke." Tocqueville described the June days as a "slave's war," and in its aftermath the Party of Order quickly consolidated its power against any furthering of revolutionary aspiration. (shrink)

Until Joseph Heath came along, philosophical business ethics was in a bad way. To the extent it’s still in a bad way, perhaps it’s because Heath has had insufficient influence. Before Heath, much of the debate in the field was between two major theories—stockholder and stakeholder theory. Both of these theories are either false, or vacuous and empty, depending on the interpretation. Heath has to some degree rescued the field by providing what is perhaps the only good general theory (...) of business ethics, which Heath calls the Market Failures Approach. This essay responds to four critical essays by Rosemary Kellison, Ebrahim Moosa, Joseph Winters, and Martin Kavka on the author’s recent book, Healthy Conflict in Contemporary American Society: From Enemy to Adversary (Cambridge, 2018). Parts I and II work in tandem to further develop my accounts of strategic empathy and agonistic political friendship. I defend against criticisms that my argument for moral imagination obligates oppressed people to empathize with their oppressors. I argue, further, that healthy conflict can be motivated (...) by a kind of “secular” love. This enables my position to immanently criticize and mediate the claims that one must either love (agapically) one’s opponent in order to engage them in “healthy conflict,” on one hand, or that one must vanquish, exclude, or “cancel” one’s opponent, on the other. In Part III, I demonstrate how my account mediates the challenge of an alleged standing opposition between moral imagination and socio-theoretical critique. I defend a methodologically pragmatist account of immanent prophetic criticism, resistance, and conflict transformation. Finally, I respond to one critic’s vindication of a strong enemy/adversary opposition that takes up the case of white supremacist violence in the U.S. I argue that the time horizon for healthy conflict must be simultaneously immediate and also long-term, provided that such engagements remain socio-critically self-reflexive and seek to cultivate transformational responses. It is not surprising that Chinese Communists took the Paris Commune as one of their models and the writings of the 'classics' of Marxism-Leninism on this subject as one of their main theoretical inspirations. More interesting, however, is the fact that one can show that the Chinese Communist leadership has continually suffered from not being quite certain what the Paris Commune really means -- either in theory or in practice.

This article investigates the semantics of sentences that express numerical averages, focusing initially on cases such as 'The average American has 2.3 children'. Such sentences have been used both by linguists and philosophers to argue for a disjuncture between semantics and ontology. For example, Noam Chomsky and Norbert Hornstein have used them to provide evidence against the hypothesis that natural language semantics includes a reference relation holding between words and objects in the world, whereas metaphysicians such as Joseph Melia (...) and Stephen Yablo have used them to provide evidence that apparent singular reference need not be taken as ontologically committing. We develop a fully general and independently justified compositional semantics in which such constructions are assigned truth conditions that are not ontologically problematic, and show that our analysis is superior to all extant rivals. Our analysis provides evidence that a good semantics yields a sensible ontology. It also reveals that natural language contains genuine singular terms that refer to numbers. (shrink)

In this essay, I look at some extraordinary actors who never got their due—actors who had distinguished careers, but never won an Academy Award for acting. I review the work of: Joseph Cotten; Orson Welles; Edward G. Robinson; Cary Grant; James Mason; Richard Burton; Claude Rains; Alan Ladd: Robert Mitchum; and Fred MacMurray. In each case, I explore the actor’s best work, what made his acting outstanding, and offer possible explanations why he was not so honored.

Dreams are used figuratively throughout Greek literature to refer to something fleeting and/or unreal. In Plato, this metaphorical language is specifically used to describe an epistemological distinction: the one who has false knowledge or opinion is said to be dreaming while the one who has true knowledge is said to be awake. These figures are also central to Philo of Alexandria's philosophical language in De somniis 1-2 and De Iosepho. Although scholars have documented these epistemological metaphors in Plato and related (...) treatments of the concept of sleep in Heraclitus, it has not been discussed in any detail in relation to Philo's treatment of Joseph in these two treatises. In De somniis 1-2, Philo primarily emphasizes his role as a dreamer and thus one incapable of true knowledge. In De Iosepho, Joseph is a dream interpreter who is not only awake but also capable of interpreting the figurative dream of life to which most people are subject. Although some scholars have considered these treatises contradictory in terms of their treatments of Joseph, an analysis of Philo's figurative use of sleep and dreaming reveals that they are a part of a coherent exegetical framework. If this displacement has destroyed the political primacy of the labor class, it has not, however, eliminated exploitation; rather, it has broadened it, implanting it within the given conditions of the (...) most diverse spheres of society. —from The Winter Is Over In late 1995, in opposition to the conservative agenda of Jacques Chirac and his prime minister Alain Juppé and their proposed widespread welfare cuts, French students rose up against their government; public sector workers, together with all the major trade unions, went on strike. When railway workers and Paris Metro personnel joined in the protests, France's public transportation system came to a halt. These extensive social upheavals, the likes of which had not been seen in France since 1968, found widespread public support and fuelled the creation of many political organizations. Chirac backed down from restructuring the public retirement system. Antonio Negri's The Winter is Over comes out of the glimmer of optimism created by the events of 1995, when the long, cold season of neoliberalism, Thatcherism, Reaganomics, reaction, and counterrevolution appeared to have run its course. Published in Italian in 1996, The Winter is Over brings together a series of articles, speeches, and other documents written by Negri between 1989 and 1995 at the threshold of this thaw. It offers a revealing and wide-reaching account of those years of change and brink-of-change, focusing on such topics as the networks of social production, the decline of “limp thought,” the end of applied socialism, the Gulf War, and, finally, Italy's transition to its so-called “Second Republic,” as seen by an exile. When Emmanuel Levinas writes (in the preface of Totality and Infinity) that Franz Rosenzweig’s Stern der Erlösung is “a work too often present in this book to be cited,” he effectively names his debt to F. W. J. Schelling as well, for Rosenzweig’s work was a sustained attempt to carry to completion Schelling’s great philosophical fragment, the Weltalter. Scholars of Levinas have explored Levinas’s relationship to Schelling, but I confess that, as a Schelling scholar, I knew nothing of this connection (...) until rather recently. I credit above all the energetic work of Jason Wirth for helping me see its importance — and more generally the importance of reading Schelling in the context of recent work in continental philosophy. None of this has been easy. The very thing that Schelling and Levinas have in common, their resistance to the implicit solipsism of overcoming mystery with clarity, make them poor candidates for quick appropriation and comparison. When Emmanuel Levinas writes that Franz Rosenzweig’s Stern der Erlösung is “a work too often present in this book to be cited,” he effectively names his debt to F. W. J. Schelling as well, for Rosenzweig’s work was a sustained attempt to carry to completion Schelling’s great philosophical fragment, the Weltalter. Scholars of Levinas have explored Levinas’s relationship to Schelling, but I confess that, as a Schelling scholar, I knew nothing of this connection until rather recently. I credit above all (...) the energetic work of Jason Wirth for helping me see its importance — and more generally the importance of reading Schelling in the context of recent work in continental philosophy. None of this has been easy. The very thing that Schelling and Levinas have in common, their resistance to the implicit solipsism of overcoming mystery with clarity, make them poor candidates for quick appropriation and comparison. Ce petit livre est concis. Il l’est peut-être trop, mais il demeure clair et stimulant. Il est axé sur des questions de justice sociale que se posent des sociaux-démocrates perplexes. Il se divise en trois parties traitant chacune d’un problème différent. Ce compte rendu les traitera l’un après l’autre, mais ils sont liés dans la pratique. Philippe Van Parijs utilise les notions de maximin, de contrat social passé derrière un voile d’ignorance et de solidarité nationale, et il fonde une partie (...) de son argumentation sur ces notions. Il discute des mérites d’une solidarité élargie à la nation, mais non d’une solidarité qui irait au-delà, bien qu’il tienne compte, à plusieurs moments, du fait que la nation soit de plus en plus tributaire d’une économie mondiale. En introduction, il rend hommage à John Rawls et André Gorz, des maîtres «avec et contre» qui il a écrit ce livre. Il dit aussi vouloir établir des principes cohérents, provisoires sans doute, mais auxquels on puisse adhérer. Il réussit certainement à les tirer au clair et à favoriser leur problématisation.
